Local Government Act 2009


1. Toowoomba Regional Council (the “Council”) has proposed to make Community and Environmental Management (Amendment) Local Law (No. 1) 2023 (the “amending local law”) and Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2023 (the “amending subordinate local law”).


2. Possible anti-competitive provisions have been identified in the amending local law and the amending subordinate local law. Council has proposed to conduct a public interest test in relation to possible anti-competitive provisions identified in the amending local law and the amending subordinate local law.


3. The purpose and general effect of the amending local law and the amending subordinate local law is to protect the environment and public health, safety and amenity within the local government area resulting from shopping trolleys removed from retail premises and left unattended on a local government controlled area or road.


4. Written submissions by any person in support of, or objecting to, the amending local law and the amending subordinate local law are invited for a period commencing on 3 February 2024 and ending on 8 March 2024 (the “consultation period”).


5. During the consultation period Council will make available for inspection and purchase at Council’s public office at:

· 4 Little Street, Toowoomba

· 95 King Street, Clifton

· 25 Emu Creek Road, Crow’s Nest

· 89 Mocatta Street, Goombungee

· O’Brien Road, Highfields

· 2-16 Campbell Street, Millmerran

· 64 Campbell Street, Oakey

· 85 Yandilla Street, Pittsworth


copies of -

(a) the amending local law;

(b) the amending subordinate local law; and

(c) a public interest test plan for the amending local law and the amending subordinate local law.


6. Submissions must be received on or before 8 March 2024 stating—

(a) the grounds of the submission; and

(b) the facts and circumstances relied on in support of the grounds.
