Notice of Intention to Seize and Remove Abandoned Property

Transport Operations (Marine Safety) Act 1994, section 175A(3)

Date of notice: 18 June 2024

I, Mark Chown, am appointed as a Shipping Inspector under part 13 of the Transport Operations (Marine Safety) Act 1994 (the Act).

Description of abandoned property:

1. ID 169409 - Ship at anchor near position -19°10.567 S 146°49.783 E, mangroves of Cockle Bay Magnetic Island.

2. ID 172277 – Black kayak near position -19°10.567 S 146°49.833 E, Cockle Bay, Magnetic Island.

3. ID 172278 – Small upturned vessel, white with red trim, near position -19°10.567 S 146°49.833 E, Cockle Bay, Magnetic Island.

4. ID 172279 – 4-meter fi breglass vessel, white, near position -19°10.567 S 146°49.833 E, Cockle Bay, Magnetic Island.

5. ID 172280 – Life raft from the SIR THOMASHILEY, near position -19°10.567 S 146° 49.833 E, Cockle Bay Magnetic Island.

6. ID 171957 – 4-meter tinnie, white, near position -19°09.617 S 146°51.133 E, tied to the public pontoon, Nelly Bay.

Where and when abandoned property was found:

The vessels were located on Magnetic Island after a site inspection by Maritime Safety

Queensland on the 12 June 2024.

I reasonably believe that all vessels listed above are abandoned property.

When abandoned property may be seized and removed:

If the property described above is not claimed by 4 pm 16 July 2024, they may be seized and removed for disposal.

Statement for the purposes of section 175A(5) of the Act:

If no one claims the property within the time stated above and I seize and remove it, I may, having regard to the value and condition of the property and without further notice–

(a) sell the property by public auction; or

(b) destroy it.

If you wish to assert ownership in the property described above, you must attend in person the Maritime Safety Queensland, Townsville at 60 Ross Street, South Townsville in the State of Queensland before 4pm on 16 July 2024.
