Proposed Amendments to Governance Rules

Council must amend its Governance Rules in order to comply with legislative changes concerning virtual Council meetings, which will come into effect in September. Proposed amendments have been prepared to meet the new legislative requirements, including detailed provisions concerning:

  • whether meetings are to be wholly attendance meetings, wholly virtual meetings or partially attendance and partially virtual meetings;
  • how, if a meeting is intended to a wholly attendance meeting, a Councillor can request that they attend by electronic means; and
  • a decision by Council as to whether it accedes to such a request.

Additionally, a number of miscellaneous changes have been proposed, including changes intended to:

  • reflect the repeal of certain provisions in the Local Government Act 1989;
  • adopt more gender neutral language;
  • make it clear that the Mayor can only be elected with an absolute majority of votes;
  • replace references to “clear days” with “business days”;
  • improve the Chair’s ability to appropriately manage questions asked by Councillors;
  • provide for the acceptance of electronic petitions, joint letters and memorials;
  • allow the Chair to adjourn a meeting to consider how to cast their casting vote;
  • provide a clear procedure to be followed in the event of opposition during the confirmation of minutes; and
  • enable the CEO to respond to criticism, at the discretion of the Chair.

Any person may make a written submission to the proposed amendments. All submissions received on or before 5pm on Wednesday, 24 August 2022 will be considered and included as part of the Council Report that will be presented to Council at its Meeting on Monday, 5 September 2022. Any person who makes a submission is entitled to request (in the submission itself) to be heard at the Council meeting in support of the submission. Submissions may also be hand delivered to the Civic Centre, or emailed to Submitters should note that unless a submitter requests to the contrary, copies of submissions (including the submitters’ names and addresses) may also be included in the Council meeting agenda and minutes, which are a permanent public record, and which are published on Council’s website.
