NOTICE PURSUANT TO SECTION 81D OF THE REAL PROPERTY ACT 1900 ('ACT')

APPLICATION TO EXTINGUISH OBSOLETE RESTRICTIVE COVENANT (AR956362) BY SUNPORK COMMERCIAL PIGGERIES PTY LTD

The above-mentioned Application has been made under Section 81J of the Act to cancel the recording of covenant B476008 (‘Restrictive Covenant’).

The Applicant is applying to have the Restrictive Covenant extinguished on the basis that it:

  1. is a fencing covenant;
  2. has been in effect for more than 12 years; and
  3. is a type of covenant likely to lose any practical value after 12 years of operation.

The Restrictive Covenant sought to be cancelled:

  1. affects the land in Folio Identifier Auto Consol 10698-112 being 240 Flanagans Lane, Matong NSW owned by the Applicant; and
  2. benefits the land in Folio Identifiers:
  • 1/180071 being 3458 Deepwater Rd, Matong NSW,
  • 70/750838 being 409 Flanagans Lane, Matong NSW,
  • 54/750838 being 442 Flanagans Lane, Matong NSW,
  • 14/750854 being 4055-5215 Old Narrandera Rd, Matong NSW,
  • 62/750854 being 5748 Old Narrandera Rd, Matong NSW,
  • 63/750854 being L63 Deepwater Rd, Matong NSW,
  • 64/750854 being 3458 Deepwater Rd, Matong NSW ,
  • 65/750854 being 5412 Old Narrandera Rd, Currawarna NSW,
  • 106/750821 being 431 Caringa Rd, Grong Grong NSW,
  • 110/750821 being 431 Caringa Rd, Grong Grong NSW and
  • 229/750821 being 431 Caringa Rd, Grong Grong NSW.

The above lots are in the vicinity of the Applicant's land being 240 Flanagans Lane, Matong NSW.

We intend to register the Application and extinguish the recording of the Restrictive Covenant from Folio Identifier Auto Consol 10698-112 unless, within one (1) month from the date of this notice you lodge at this Office, pursuant to section 74F(4B) of the Act, a caveat on form 08X prohibiting the granting of the Application, accompanied by the prescribed fee (currently $147.70).
