2024-25 Rates

(NOTIFICATION UNDER SECTION 118 OF THE LOCAL GOVERNMENT ACT 1993)

Notice is hereby given that on 24th June 2024, Council resolved to make certain Rates upon rateable land within the Hobart Municipal area in respect of the year ending 30 June 2025. In summary the Council resolved that:-

  1. Rates and Charges be made in accordance with the provisions of Part 9 of the Local Government Act 1993 and the Fire Services Act 1979, to provide for the estimates of revenue and expenditure for the period commencing 1 July 2024 and ending on 30 June 2025.

  1. General Rate

  1. Pursuant to s.90 of the Local Government Act 1993, a General Rate of 0.2917 cents in the dollar of Capital Value be made.

2.2 Pursuant to s.107 of the Local Government Act 1993 Council declares by absolute majority that the General Rate is varied according to the use or predominant use of land, as follows:

  1. for land used for commercial purposes, vary the General Rate to 0.6104 cents in the dollar of Capital Value.
  2. for land used for industrial purposes, vary the General Rate to 0.6104 cents in the dollar of Capital Value.
  3. for land used for primary production purposes, vary the General Rate to 0.2214 cents in the dollar of Capital Value.
  4. for land used for public enterprise purposes, vary the General Rate to 0.3756 cents in the dollar of Capital Value.
  5. for land used for residential purposes, vary the General Rate to 0.2214 cents in the dollar of Capital Value.
  6. For land used for residential short stay visitor accommodation purposes, vary the General Rate to 0.4428 cents in the dollar of Capital Value.
  7. for land used for sporting or recreation facilities purposes, vary the General Rate to 0.2947 cents in the dollar of Capital Value.
  8. for non-use of the land, vary the General Rate to 0.2753 cents in the dollar of Capital Value.
  9. for non-use residential land, vary the General Rate to 0.5506 cents in the dollar of Capital Value.

  1. Pursuant to s.88A(1)(a) and (b) of the Local Government Act 1993 the Council by absolute majority sets and declares that the maximum percentage increase cap on the General Rate for land use or predominately used for commercial and industrial purposes (as previously made and varied in 2.1 and 2.2 above) is 10% above the amount payable in respect of that rateable land in the 2023-24 financial year.

  1. Pursuant to s.88(2)(b) of the Local Government Act 1993 the Council by absolute majority fixes the condition that to qualify for the maximum percentage increase cap (as previously made and varied above) the rateable lad must not be subject to a supplementary valuation issued by the Valuer-General during the period from 1 July 2024 to 30 June 2025.

3 Service Rates

3.1 Pursuant to s93 of the Local Government Act 1993, a Stormwater Removal Service Rate of 0.00226 cents in the dollar of Capital Value be made.

3.1.1 Pursuant to s.107 of the Local Government Act 1993 Council declares by absolute majority that the Stormwater Removal Service Rate is varied according to the use or predominant use of land, as follows:

  1. for land used for commercial purposes, vary the Stormwater Removal Service Rate to 0.0374 cents in the dollar of Capital Value.

  1. for land used for industrial purposes, vary the Stormwater Removal Service Rate to 0.0339 cents in the dollar of Capital Value.

  1. for land used for primary production purposes, vary the Stormwater Removal Service Rate to 0.0194 cents in the dollar of Capital Value.

  1. for land used for public enterprise purposes, vary the Stormwater Removal Service Rate to 0.0201 cents in the dollar of Capital Value.

  1. for land used for residential purposes, vary the Stormwater Removal Service Rate to 0.0187 cents in the dollar of Capital Value.

  1. for land used for sporting or recreation facilities purposes, vary the Stormwater Removal Service Rate to 0.0120 cents in the dollar of Capital Value.

  1. for non-use of the land, vary the Stormwater Removal Service Rate to 0.0193 cents in the dollar of Capital Value.

3.2 Pursuant to s.93A of the Local Government Act 1993 and the provisions of the Fire Service Act 1979 (as amended) the Council makes the following rates for land within the municipal area:

  1. A permanent brigade district fire rate of 0.0534 cents in the dollar of Capital Value subject to a minimum amount of $49 in respect of all rateable land within the permanent brigade rating district.

  1. A Fern Tree volunteer brigade district fire rate of 0.0135 cents in the dollar of Capital Value subject to a minimum amount of $49 in respect of all rateable land within the Fern Tree volunteer brigade rating district.

  1. A general land fire rate of 0.0130 cents in the dollar of Capital Value subject to a minimum amount of $49 in respect of all rateable land within the municipal area which is not within the permanent brigade rating district or the Fern Tree volunteer brigade rating district.

3.2.1 Pursuant to s.107 of the Local Government Act 1993 Council declares by absolute majority that the permanent brigade district fire rate is varied within the permanent brigade rating district according to the use or predominant use of land, as follows:

  1. for land used for commercial purposes, vary the permanent brigade district fire rate to 0.0830 cents in the dollar of Capital Value.

  1. for land used for industrial purposes, vary the permanent brigade district fire rate to 0.0743 cents in the dollar of Capital Value.

  1. for land used for primary production purposes, vary the permanent brigade district fire rate to 0.0424 cents in the dollar of Capital Value.

  1. for land used for public enterprise purposes, vary the permanent brigade district fire rate to 0.0890 cents in the dollar of Capital Value.

  1. for land used for residential purposes, vary the permanent brigade district fire rate to 0.0420 cents in the dollar of Capital Value.

  1. for land used for sporting or recreation facilities purposes, vary the permanent brigade district fire rate to 0.0236 cents in the dollar of Capital Value.

  1. for non-use of the land, vary the permanent brigade district fire rate to 0.0416 cents in the dollar of Capital Value.

  1. Service Charges

  1. A Waste Management Service Charge of $290.00 for residential properties and $580.00 for non-residential properties be made pursuant to s.94 of the Local Government Act 1993.

  2. A Waste Management Service Charge for food organics garden organics waste collection fortnightly of $82.00 and weekly of $170.00 for properties to which Council supplies or makes available a food organics garden organics waste collection service utilising a food organics garden organics waste collection bin be made pursuant to s.94 of the Local Government Act 1993.

4.3. Pursuant to s.94 of the Local Government Act 1993, a service charge be made for waste management services to offset a levy payable by the Council to the State Government under the Waste and Resource Recovery Act 2022 (a Waste Management Levy Offset Service Charge) in the sum of $48.00 for all rateable land within the municipal area.

4.3.1 Pursuant to s.94(3) of the Local Government Act 1993, the Council by absolute majority hereby varies the Waste Management Levy Offset Service Charge (as previously made) for all rateable land in the municipal area which is used or predominantly used for residential purposes to $24.00.

  1. Pursuant to s.94 of the Local Government Act 1993 the Council makes the following service charges on all rateable land within the municipal area of Hobart (including land which is otherwise exempt from rates pursuant to s.87 but excluding land owned by the Crown to which the Council does not supply any of the following services), namely:

service charges for waste management in respect of all land to which the Council supplies different waste management services comprising:

(i) the supply of mobile garbage bins;

(ii) the supply of a recycling service;

(iii) the supply of a food organics garden organics collection service;

As follows:

$113.00 initial service charge for waste or recycling, residential or non-residential.

$185.00 upgrade from a 120Lt to 240Lt mobile garbage bin residential.

  1. Pursuant to s.124 of the Local Government Act 1993, the Rates may be payable by four instalments.

  1. The Rates shall be payable on the following dates:-

1st Instalment 15 August 2024

2nd Instalment 15 November 2024

3rd Instalment 15 February 2025

4th Instalment 15 April 2025

6. For lands otherwise exempt from General Rates pursuant to s.87 of the Local Government Act 1993, Service Rates, pursuant to s.93 and Service Charges pursuant to s.94 of the Local Government Act 1993 will apply.

7. Penalty and Interest

Pursuant to s.128 of the Local Government Act 1993;

(a) where any amount of rates or charges remains unpaid after the date on which it is to be paid, there shall be payable penalty and interest in accordance with s.128(1)(c), with penalty to be calculated at the rate of 3% of the amount and interest on that amount calculated at the rate of 10.14% per annum, charged monthly, in accordance with the prescribed percentage contained in s.128(2).

(b) where any amount of rates or charges that were payable in a financial year beginning prior to 1st July 2024, remains unpaid in the financial year beginning 1st July 2024, and there is payable interest on that amount pursuant to a determination under s.128(1)(c) in that first-mentioned financial year, there shall be payable interest on that amount on and after 1st July 2024, at a rate equal to the rate fixed for the purposes of s.128(1)(c) and operative on and after 1st July 2024, being at a rate of 10.14% per annum, charged monthly.
