GUNGGARI PEOPLE #4

NATIVE TITLE and INDIGENOUS LAND USE AGREEMENTS AUTHORISATION MEETINGS

The Gunggari People have made a claimant application to the Federal Court of Australia seeking recognition of their native title rights and interests under the Native Title Act 1993 (Cth). The claim is Gunggari People #4 (QUD19/2019) (‘the Native Title Claim’).

 

The Gunggari People #4 native title claim group is currently described as the descendants of the following people:

 


 

  1. Jinnegah;
  2. Jimmy and Nelly Flourbag;
  3. Harry Collins;
  4. Old Frog;
  5. Coombra Jack;
  6. Kitty of St George and Maggie of the Moonie;
  7. King Billy Dick;
  8. Maria of Tongy Station;
  9. Harry Rookwood;
  10. Lucy of the Balonne River;
  11. Charlotte Moffat;
  12. Mary of the Maranoa;
  13. Nellie Walker;
  14. Clifton George;
  15. Mary of Bollon;
  16. Kate Meathers/Meadows.


 


This notice invites all members of the Gunggari People #4 native title claim group as described above to attend a native title authorisation meeting (‘Meeting #1’) at the time, date and location below:

Meeting #1 (Authorisation of Amendment to Claim Group Description)

 

Date:               Saturday, 1 June 2019

Venue:            Great Artesian Spa Hall, 2 Cambridge Street, Mitchell, QLD

Time:              9:30am (registration commencing at 9:00am)

 

The purpose of Meeting #1 is to:

  1. CONSIDER anthropological materials and legal advice regarding the claim group description for the Native Title Claim; and
  2. Subject to #1 above, AUTHORISE the amendment of the claim group description for the Native Title Claim.

If the proposed amendment to the claim group description for the Native Title Claim is authorised, then the amended claim group description for the Native Title Claim will be the descendants of the following people:


 

  1. Jinnegah aka Mary and Albert Murray;
  2. Lizzie Woodford/Gyemore/South;
  3. Harry Collins and Dinah Smith;
  4. Old Frog;
  5. Effie Armstrong, the granddaughter of Coombra Jack;
  6. Kitty of St George aka Mary Bolon, the mother of George Hazzard Jnr aka Henry James Hazzard.
  7. Maggie of the Moonie, the mother of Sarah Brennan and Isabella Kerr;
  8. King Billy Dick;
  9. Maria of Tongy Station;
  10. Harry Rookwood;
  11. Lucy of the Balonne River;
  12. Charlotte Moffat;
  13. Parents of Mary of the Maranoa and Lizzie;
  14. Nellie Walker;
  15. Clifton George;
  16. Mary of Bollon; or
  17. Kate Meathers/Meadows.


 

 

If the proposed amendment to the Native Title Claim is made at Meeting #1, then Meeting #2 will be open to the amended Gunggari People #4 native title claim group as described above.

Meeting #2 (Authorisation of Applicant)

Date:               Saturday, 1 June 2019

Venue:            Great Artesian Spa Hall, 2 Cambridge Street, Mitchell, QLD

Time:              To commence immediately after the conclusion of Meeting #1.


The purpose of Meeting #2 is to:

  1. AUTHORISE persons to be (or continue to be) the Applicant for the Native Title Claim, to make the application to amend the claim group description and to deal with matters arising in relation to the Native Title Claim; and
  2. Subject to #1 above, AUTHORISE the Applicant (but only if newly comprised) to make an application to the Federal Court for orders replacing the existing Applicant for the Native Title Claim.

Meeting #3 will be open to all members of the Gunggari People (including the Gunggari People #4 native title claim group as amended at Meeting #1).

 

Meeting #3 (Authorisation of Consent Determination)

Date:               Saturday, 1 June 2019

Venue:             Great Artesian Spa Hall, 2 Cambridge Street, Mitchell, QLD

Time:               1:00pm

 

The purpose of Authorisation Meeting #3 is to:

  1. CONSIDER legal advice in relation to proposed consent determination orders to be made in relation to the Native Title Claim;
  2. AUTHORISE and CONSENT to the terms of consent determination orders that would resolve the Native Title Claim;
  3. CONSENT to the Gunggari Native Title Aboriginal Corporation RNTBC (‘Gunggari PBC’) holding the native title in trust upon determination of the Native Title Claim;
  4. Subject to #1 and #2 above, AUTHORISE the Applicant (including any newly comprised/replacement Applicant) to make any necessary applications or amendments to the Native Title Claim in order to:
    1. reflect the decisions made at Meeting #1 and #2;
    2. bring the Native Title Claim into alignment with the terms of the proposed consent determination orders, including to reduce the area of the land and waters claimed (to remove non-claimable areas) and amend the list of native title rights and interests claimed; and
    3. agree to settlement of the Native Title Claim broadly on the terms of the proposed consent determination orders.

Meeting #4 (Authorisation of ILUAs)

Date:               Sunday, 2 June 2019

Venue:            Great Artesian Spa, 2 Cambridge Street, Mitchell, QLD

Time:              9:30am (registration commencing at 9:00am)

 

The purpose of Authorisation Meeting #4 is to:

  1. AUTHORISE and CONSENT to separate Indigenous Land Use Agreements (ILUAs) between the Gunggari People #4, the Gunggari PBC, and Maranoa Regional Council (‘Gunggari #4/Maranoa ILUA’) and the Gunggari People #4, the Gunggari PBC and Murweh Shire Council (‘Gunggari #4/Murweh ILUA’).  Each ILUA will provide, among other things:
    1. a mechanism for resolving native title issues with the relevant local government within each ILUA area; and
    2. a protocol for the protection of Aboriginal Cultural Heritage within each ILUA area.
  2. AUTHORISE and CONSENT to entry into an ILUA between the Gunggari People #4, the Gunggari PBC, and Ergon Energy Corporation Limited (‘Gunggari #4/Ergon ILUA’). The ILUA will provide, among other things:
    1. a mechanism for resolving native title issues with Ergon Energy within the ILUA area; and
    2. a protocol for the protection of Aboriginal Cultural Heritage within the ILUA area.
  3. AUTHORISE and CONSENT to entry into an ILUA between the Gunggari People #4, the Gunggari PBC, and the State of Queensland (‘the Gunggari#4/State ILUA’).  The ILUA will provide, among other things:
    1. resolution of land tenure issues with respect to certain parcels of land located within the ILUA area; and
    2. benefits, including in the form of land to be transferred to the Gunggari People.
  4. AUTHORISE and CONSENT to entry into separate ILUAs between the Gunggari People #4, the Gunggari PBC, and various pastoral respondents, including: Adrian Wentworth Bucknell and Jennifer Narelle Bucknell / Bucknell Enterprises Pty Ltd in relation to Lot 4784 on PH644; Harry Sibun Perrett and Erica Jan Perrett in relation to Lot 8 on SP281196; Henry Richard Thomas Whitton Lot 3480 on CP WAR805968; Susan Fae Wilson and Warren Gavin Wilson in relation to part of Lot 6 on BDR97; and Babbiloora Pty Ltd (ACN 078 837 537) in relation to Lot 1018 on CP PH1213.   Each ILUA will provide, among other things, a protocol for the exercise of the Gunggari People’s native title rights and interests within each ILUA area in a manner that is not inconsistent with the pastoral respondents’ rights and obligations under their pastoral lease.

The areas of each of the ILUAs to be authorised at Meeting #4 cover land and waters within the external boundaries of the Gunggari People #4 (QUD19/2019) Native Title Claim as follows:

  • Gunggari #4/Maranoa ILUA – the area of the Maranoa Regional Council local government area covered by the Gunggari People #4 Native Title Claim;
  • Gunggari #4/Murweh ILUA – the area of the Murweh Shire Council local government area covered by the Gunggari People #4 Native Title Claim;
  • Gunggari #4/Ergon ILUA – the area of the Gunggari People #4 Native Title Claim;
  • Gunggari #4/State ILUA – particular land parcels (or part parcels) falling within the area of the Gunggari People #4 Native Title Claim;
  • Gunggari #4 pastoral ILUAs – the areas of the land parcels mentioned at #4 above for each pastoralist party which fall within the area of the Gunggari People #4 Native Title Claim.

INFORMATION SESSION

An Information Session will be held the day prior to the Authorisation Meetings to assist the Gunggari People to prepare for, and make informed decisions at the Authorisation Meetings.
